Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the eSIM Transfer service operated by eSIM Transfer ("we", "us", or "our"). By accessing or using our service, you agree to be bound by these Terms.

Our service is provided from Spain and is subject to European Union regulations, including but not limited to the General Data Protection Regulation (GDPR) and the Digital Services Act.

2. Service Description

eSIM Transfer provides digital SIM card management services, including:

  • Purchase and management of eSIM profiles
  • Account credit management
  • eSIM activation and configuration support
  • Customer support services

3. User Accounts

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use

You must be at least 16 years old to create an account. If you are under 18, you must have parental consent.

4. Payments and Refunds

All payments are processed in Euros (EUR) through Stripe. By making a purchase, you agree to pay all charges incurred.

4.1 Credit Purchases

Credit purchases are final and non-refundable except as required by applicable law. Credits do not expire and remain in your account until used.

4.2 eSIM Purchases

eSIM purchases may be cancelled within 14 days of purchase if the eSIM has not been activated, in accordance with EU consumer protection laws.

4.3 Refund Process

To request a refund, contact our support team within the applicable timeframe. Refunds will be processed within 14 days of approval.

5. Use Restrictions

You agree not to:

  • Use the service for illegal activities
  • Violate any applicable laws or regulations
  • Interfere with the service's operation
  • Attempt to gain unauthorized access to our systems
  • Use the service to harm others or infringe on their rights
  • Resell eSIMs without our written permission

6. Intellectual Property

All content, trademarks, and intellectual property related to eSIM Transfer remain our exclusive property. You may not copy, reproduce, or distribute our content without written permission.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which complies with GDPR requirements. By using our service, you consent to our data practices as described in our Privacy Policy.

8. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may temporarily suspend the service for maintenance or updates with reasonable notice when possible.

9. Limitation of Liability

To the maximum extent permitted by law, eSIM Transfer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data.

Our total liability to you shall not exceed the amount you paid for the service in the 12 months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account for violations of these Terms. Upon termination, your right to use the service ceases immediately.

11. Governing Law and Disputes

These Terms are governed by Spanish law and EU regulations. Any disputes shall be resolved through the competent courts in Spain.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new Terms.
